Eliotron Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Eliotron platform (“Platform”), including all content, analytics, features, and services provided by Eliotron. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must stop using the Platform.

1. Definitions

1.1 "Platform" refers to the Eliotron software service, including all web applications, APIs, analytics dashboards, reports, and related systems.

1.2 "Services" means all tools, reports, AI functionalities, analytics, insights, dashboards, APIs, and integrations offered through the Platform.

1.3 "User" refers to any individual or entity who accesses or uses the Platform, whether through a free trial, paid subscription, or other authorized means.

1.4 "Authorized User" refers to any individual granted access to the Platform under a User’s subscription plan.

1.5 "Content" refers to all reports, analytics, insights, charts, data, text, images, and materials provided within the Platform.

1.6 "Aggregated Data" refers to data compiled, processed, or modeled by Eliotron from public data, open data sources, licensed partners, user-submitted data, and other lawful data providers.

1.7 "Access Credentials" includes usernames, passwords, API keys, and any method used to authenticate a User.

2. Acceptance of Terms

By using the Platform, you confirm that you:

• - Are at least 18 years old or the legal age in your jurisdiction;
• - Agree to comply with these Terms and all applicable laws;
• - Have authority to bind your organization, if applicable.

Eliotron operates from Canada and Morocco, but legal enforcement and governing law remain exclusively governed by Section 14 below.

3. Description of Services

Eliotron is an e-commerce intelligence platform providing analytics, benchmarking, product research, competitor insights, AI-powered market analysis, and business performance indicators. The Platform enables Users to:

• - Benchmark stores against competitors;
• - Identify winning products and profitable niches;
• - Track estimated sales, revenue trends, and performance metrics;
• - Access AI-driven insights for business growth and optimization.

Insights are based on aggregated, processed, and modeled data from public sources, open-data providers, licensed partners, user-input data, and data permitted through legitimate use of third-party services.

4. Use of the Platform

4.1 Permitted Use

You may use the Platform only for lawful business purposes and within the scope of your subscription plan. Permitted uses include analytics, research, benchmarking, competitor analysis, AI insights, API usage, and internal decision-making.

You are responsible for ensuring all Authorized Users comply with these Terms.

4.2 Prohibited Use

You agree NOT to:

• - Use bots, crawlers, spiders, or automated tools to extract Eliotron Content;
• - Copy, resell, or redistribute Platform Content to unauthorized third parties;
• - Attempt to bypass authentication, security, or access controls;
• - Reverse-engineer the Platform or attempt to derive its source code;
• - Use the Platform in a way that violates third-party service terms;
• - Interfere with the Platform or degrade system performance;
• - Engage in fraudulent, illegal, or unauthorized activities.

5. Account Management

5.1 Registration

You must provide accurate and complete information to register an account. Eliotron may request additional verification and may suspend accounts with false or incomplete information.

You represent that:

• - Your registration information is accurate;
• - You are not barred from using the Platform;
• - You will update your information as needed.

5.2 Authorized Users

If your subscription includes multiple seats, you may grant access to additional individuals. You are responsible for all actions performed under your account, including misuse by Authorized Users.

5.3 Account Security

You are responsible for maintaining confidentiality of your Access Credentials. Any unauthorized use must be reported immediately to [email protected].

6. Subscriptions and Billing

6.1 Free Trial

Eliotron offers a 7-day free trial. Unless canceled before expiration, your subscription will automatically begin and the payment method on file will be charged.

6.2 Subscription Plans

Eliotron offers:

• - Explore
• - Advance
• - Command (custom terms upon request)

All payments are non-refundable. Subscriptions renew automatically unless canceled. Users are responsible for maintaining valid payment information.

6.3 Automatic Renewal

Plans renew automatically unless canceled at least 3 days before the renewal date. Charges are final and non-refundable.

7. Refund Policy

All subscription fees are final and non-refundable. Canceling a plan prevents future charges but does not refund the current period.

8. Intellectual Property

All rights in the Platform, including software, analytics, models, visualizations, and branding, belong exclusively to Eliotron. Users may not copy, modify, distribute, or reproduce Platform Content.

Eliotron does not claim ownership over third-party trademarks, products, or merchant content referenced in analytics.

9. Data and Accuracy Disclaimer

Data insights and analytics provided by the Platform may include estimates, projections, or modeled results. Eliotron cannot guarantee accuracy, completeness, or real-time precision.

10. Alpha Features Notice

Alpha and experimental features may contain errors, bugs, or instability. They are provided “as is,” and Eliotron is not liable for any issues resulting from their use.

11. Reporting and Support

Report issues or suspicious activity to [email protected].

12. Limitation of Liability

Eliotron is not responsible for indirect, incidental, special, or consequential damages, including loss of revenue, data, or business opportunities.

Maximum liability is limited to the subscription fees paid in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify Eliotron against claims, losses, or damages arising from your use of the Platform or violation of these Terms.

14. Governing Law

These Terms are governed exclusively by the laws of the Province of Québec, Canada. Any dispute must be resolved in the courts of Québec, sitting in Montréal. By using the Platform, you consent to this jurisdiction.

15. Amendments

Eliotron may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance.

16. Termination

Eliotron may suspend or terminate your access for violations, non-payment, security risks, or misuse. Users may cancel anytime via account settings.
